The paintings offered for sale on this website may be purchased through the Shopping Cart at the price stated. An additional charge may be made to cover postage, packing and insurance, etc., If any additional charge is made, it will be specified by the Shopping Cart at the point of purchase and before any payment is made.
The paintings offered for sale on this website are also offered for sale in other venues. If for any reason the painting you have purchased through the Shopping Cart has already been sold through another venue, a full refund will be issued to you as quickly as reasonably possible. Joyce Ozier cannot accept any responsibility for such a mishap other than to issue a full refund to you.
All paintings purchased from Joyce Ozier, unless delivered personally, must be delivered to you by a carrier or postal service (herinafter called ‘the carrier’).
This means that the painting is despatched to you pursuant to a contract with the carrier. Consequently, any risk of loss of the painting, or loss of title to the painting passes to you immediately upon Joyce Ozier’s delivery of the painting to the carrier.
Joyce Ozier endeavours to be as accurate as possible with any description of each painting. In addition, photographs of each painting are displayed in several places on this website. However, it is a well-known problem with computer screens or monitors that they often vary in their colour rendition from screen to screen. Therefore, Joyce Ozier cannot guarantee that the colours you see on your screen are exactly the same as the actual painting which you may purchase.
There may be slight variations. You therefore agree that this shall not be an adequate reason to cancel your purchase, and that you will accept such slight variations in colour as being within the normal risks of doing business over the internet.
Standard Practice – If a painting is returned for any acceptable reason, the title shall remain with the purchaser until the painting is physically accepted by Joyce Ozier from the carrier. Only after the painting is physically accepted by Joyce Ozier, and the title thereby accepted can a refund be issued.
Exceptions – At Joyce Ozier’s discretion a refund may be issued without the painting in question being returned. If this happens it shall not set a precedent and each case shall be decided upon its merits.
The entire contents of the Site are protected by international copyright and trademark laws. The owner of the copyrights and trademarks is Joyce Ozier This website may also contain copyright materials submitted by affiliates, advisers, technicians or other third parties. You may not modify, copy, reproduce, republish, upload, post, transmit, or distribute, in any manner, the material on the Site, including text, graphics, code and/or software. You may print and download portions of material from the different areas of the Site solely for your own personal use provided that you agree not to modify the material in any way whatsoever, nor to change or delete any copyright or proprietary notices from the materials.

You agree that any legal action or proceeding between Joyce Ozier and you for any purpose concerning this Agreement or the parties’ obligations hereunder shall be brought exclusively in a court of competent jurisdiction sitting in Vancouver, British Columbia, Canada.
Any cause of action or claim you may have with respect to the Service must be commenced within one (1) year after the claim or cause of action arises or such claim or cause of action is barred. Joyce Ozier’s omission or failure to insist upon or enforce strict performance of any provision of this Agreement shall not be
construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any provision of this Agreement. Joyce Ozier may assign its rights and duties under this Agreement to any party at any time without notice to you.
Any and all additional policy notices and agreements posted on the Site shall be part of this Agreement.
